Booking Terms + Conditions
When you make a reservation, you and those on whose behalf you are booking enter into an agreement between TruExperiences Tours Inc. and others who will provide services for your reservation. Reservations are subject to the Terms and Conditions outlined below and the Terms and Conditions of the individual suppliers.
RESERVATION + PAYMENT
Payment must be received by TruExperiences Tours Inc. as follows:
For reservations made 61 days or more prior to departure: 50% deposit (balance due 60 days prior to departure)
For reservations made 0-60 days prior to departure: Full payment due at time of booking
Space is subject to availability at time of booking.
Prices may be higher than advertised due to special events, premium nights and holidays.
Group reservations and certain travel services may have different payment due dates, date change fees and cancellation fees.
In the event that the payment is not paid by the due date(s), TruExperiences Tours Inc. reserves the right to cancel the reservation.
CREDIT CARDS
Your authorization to use your credit card number for payment indicates your agreement with our booking Terms and Conditions, whether or not you have signed the appropriate draft.
For travel agency bookings, a letter of confirmation signed by the cardholder authorizing the use of the credit card without a signature must be kept on file by the travel agency. In the event that a cardholder refuses to honour a charge, the travel agency will be held responsible for the full payment.
CANCELLATION FEES
61 days or more prior to departure: $250.00 per person plus non-refundable airfare
31-60 days prior to departure: 50% of the travel services
30 days or less prior to departure: 100% of the travel services
No show: 100% of the travel services
Gift certificates are 100% non-refundable.
Event tickets cancelled are 100% non-refundable.
Certain travel services may be sold as 100% non-refundable.
Tours not operated by TruExperiences Tours Inc. may have higher cancellation fees. Please ask us for details.
Cancellation fees are liquidated damages to compensate TruExperiences Tours Inc. for prepayments made on advance booking of travel services and for administrative costs involved in processing a cancellation.
CHANGES
Changes to travel service components are subject to an administrative fee to be determined by TruExperiences Tours Inc. All changes are subject to availability at time of booking.
VOUCHERS
Travel vouchers must be presented when required by the service provider. If you fail to present the appropriate voucher(s), TruExperiences Tours Inc. is not responsible if a service provider declines to honour your reservation. You are also bound by each supplier's own Terms and Conditions.
DOCUMENTATION
It your responsibility to ensure that you have the required documents for entry to the destination. In the event that you are denied entry for any reason, no refund for unused travel services will be considered. Passengers travelling between Canada and the United States must carry a valid passport.
LOST/DAMAGED BAGGAGE
Lost/damaged baggage is the responsibility of the supplier not TruExperiences Tours Inc.
EXCESS BAGGAGE CHARGES
TruExperiences Tours Inc. is not responsible for excess baggage charges.
TYPOGRAPHICAL ERRORS
In the event of a typographical error, TruExperiences Tours Inc. reserves the right to re-price or change any quote with or without notice.
REFUNDS
Unused services are non-refundable and non-transferable. Refunds will also not be made for cancellation due to inclement weather or illness.
INSURANCE
The purchase of adequate insurance is strongly recommended. This includes, but is not limited to, medical, trip cancellation and trip interruption insurance.
MODIFICATIONS TO TRAVEL SERVICES
TruExperiences Tours Inc. reserves the right to make any changes to travel services, including, but not limited to, changes to hotel accommodations, sightseeing tours, transportation and schedule with or without notice. No compensation will be provided for modifications to travel services. Hotel preferences such as bedding are on a request basis only.
PRICES
Prices are subject to change without prior notice.
No price increases will be made after you have paid the deposit.
CANCELLATION BY TRUEXPERIENCES TOURS INC.
TruExperiences Tours Inc. reserves the right to cancel any reservation at any time. In the event of cancellation, our liability will be limited to a full refund of all payments made to TruExperiences Tours Inc.
LOCAL CONDITIONS
Local conditions may differ from those in your home country. TruExperiences Tours Inc. cannot be held responsible for any sickness or inconvenience arising as a result of the different living standards.
TRANSPORTATION DELAYS/CANCELLATIONS
If you are unable to make the start date for any tour or cruise purchased from TruExperiences Tours Inc., it is your responsibility to work with the airline, train or other transportation company on which you are ticketed to reach your destination. TruExperiences Tours Inc. is not responsible for any additional expenses you may incur prior to starting your tour or cruise. TruExperiences Tours Inc. is not responsible for and will not provide any refund for portions of travel services missed due to cancelled or delayed flights, trains or other transportation. This includes, but is not limited to, cancellations and/or delays as a result of weather.
HOTEL CONSTRUCTION
TruExperiences Tours Inc. is not responsible for any inconvenience arising from hotel construction.
WEBSITE AND BROCHURE ACCURACY
TruExperiences Tours Inc. is not responsible for factors beyond our control which alter the accommodations, trains, flights or optional activities and tours. All photographs in the brochure and website are purely representational and are not a guarantee that everything will be as depicted upon arrival at your destination.
ACT OF GOD / FORCE MAJEURE
TruExperiences Tours Inc. is not responsible for any loss, damage or injury resulting from an Act of God or any other force majeure.
PASSENGER RESPONSIBILITY
TruExperiences Tours Inc. reserves the right to decline to accept any person as a member of a tour or cruise, or to require any participant to withdraw from a tour or cruise at any time when such action is determined to be in the best interests of the health, safety, and general welfare of the tour group or the individual participant. No refunds will be provided and the person is responsible for any transportation expenses to return home.
Tour participants may be photographed for promotional purposes and no compensation will be provided.
TRUEXPERIENCES TOURS INC.'S RESPONSIBILITY
TruExperiences Tours Inc. makes arrangements with hotels, rail companies, airlines, tour operators and other independent parties to provide travel services. Although we take care in selecting these suppliers, we have no control over them, and, therefore, cannot be held responsible for their acts or omissions. The liability of TruExperiences Tours Inc. for any loss, damage, or injury of any nature or kind whatsoever, arising out of its own acts, omissions or negligence, is limited to the amount paid for the travel services. Except as set out above TruExperiences Tours Inc. will not be liable for any loss, damage or injury of any kind whatsoever to person or property.
CLAIMS
You agree that any claims against TruExperiences Tours Inc. shall be made in writing and received by TruExperiences Tours Inc. no later than 30 days after the event causing the claim. Claims made after 30 days will not be responded to.
DISPUTE RESOLUTION
The exclusive venue for all claims, actions or proceedings against TruExperiences Tours Inc. arising out of this contract shall be the Province of Ontario and such claims, actions or proceedings shall be determined by binding arbitration according to the laws of the Province of Ontario and Canada.
SEVERABILITY
The invalidity of any provision contained herein shall not affect the validity of any other provision. Your reservation deposit indicates acceptance of the above Terms and Conditions and limits on responsibility.
