BOOKING TERMS

When you make a booking, you and those on whose behalf you are booking enter into an agreement between TruExperiences Tours Inc. and others who will provide services for your booking.

BOOKING + PAYMENT – SMALL GROUP TOURS
Full payment is due at time of booking.  Cancellations can be made without penalty 7 days or more prior to the tour date.  

BOOKING + PAYMENT – PRIVATE + CUSTOM TOURS
Payment must be received by TruExperiences Tours as follows:
Booking made 31 days or more prior to tour date: 10% non-refundable deposit with the balance due 30 days prior to the tour date.
Booking made 0-30 days prior to tour date: Full payment is due at time of booking.

Prices and availability are subject to change until payment is processed.
Group bookings and certain tours may have different payment due dates, date change fees and cancellation fees.
In the event that the payment is not paid by the due date(s), TruExperiences Tours reserves the right to cancel the booking.

CREDIT CARDS
Your authorization to use your credit card number for payment indicates your agreement with our Booking Terms and Conditions, whether or not you have signed the appropriate draft. TruExperiences Tours is not responsible for bank exchange rates/fees on credit card transactions.
For travel agency bookings, a letter of confirmation signed by the cardholder authorizing the use of the credit card without a signature must be kept on file by the travel agency. In the event that a cardholder refuses to honor a charge, the travel agency will be held responsible for the full payment.

CANCELLATION FEES – SMALL GROUP TOURS
7 days or more prior to tour date: No penalty
0-6 days prior to tour date: 100% of total price

CANCELLATION FEES – PRIVATE + CUSTOM TOURS
14 days or more prior to tour date: 10% of total price
0-13 days prior to tour date: 100% of total price

Cancellation fees are liquidated damages to compensate TruExperiences Tours for prepayments made on advance booking of tours and for administrative costs involved in processing a cancellation.

DATE CHANGES – SMALL GROUP TOURS
Date changes to another date within the current tour season are permitted without penalty up to 72 hours prior to your original tour date. Date changes are subject to availability.

LOST/DAMAGED BAGGAGE
TruExperiences Tours is not responsible for lost or damaged baggage.

TYPOGRAPHICAL ERRORS
In the event of a typographical error, TruExperiences Tours reserves the right to re-price or change any quote with or without notice.

REFUNDS
Unused services are non-refundable and non-transferable. Refunds will also not be made for cancellation due to inclement weather or illness.

INSURANCE
The purchase of adequate insurance is strongly recommended. This includes, but is not limited to, medical, trip cancellation and trip interruption insurance.

MODIFICATIONS TO TRAVEL SERVICES
TruExperiences Tours reserves the right to make any changes to the tours, including, but not limited to, changes to vehicle type and tour schedule with or without notice. No compensation will be provided for modifications to any tour.

CANCELLATION BY TRUEXPERIENCES TOURS
TruExperiences Tours reserves the right to cancel any booking at any time. In the event of cancellation, our liability will be limited to a full refund of all payments made to TruExperiences Tours.

TRANSPORTATION DELAYS/CANCELLATIONS
If you are unable to make the start date for any tour purchased from TruExperiences Tours, it is your responsibility to work with the airline, train or other transportation company on which you are ticketed to reach your destination. TruExperiences Tours is not responsible for any additional expenses you may incur prior to starting your tour. TruExperiences Tours is not responsible for and will not provide any refund for portions of travel services missed due to cancelled or delayed flights, trains or other transportation. This includes, but is not limited to, cancellations and/or delays as a result of weather.

ACT OF GOD/FORCE MAJEURE
TruExperiences Tours is not responsible for any loss, damage or injury resulting from an Act of God or any other force majeure.

PASSENGER RESPONSIBILITY
TruExperiences Tours reserves the right to decline to accept any person as a member of a tour or to require any participant to withdraw from a tour at any time when such action is determined to be in the best interests of the health, safety, and general welfare of the tour group or the individual participant. No refunds will be provided and the person is responsible for any transportation expenses to return home. Tour participants may be photographed for promotional purposes and no compensation will be provided.

TRUEXPERIENCES TOURS’ RESPONSIBILITY
TruExperiences Tours makes arrangements with other independent parties to provide services. Although we take care in selecting these suppliers, we have no control over them, and, therefore, cannot be held responsible for their acts or omissions. The liability of TruExperiences Tours for any loss, damage, or injury of any nature or kind whatsoever, arising out of its own acts, omissions or negligence, is limited to the amount paid for the tour. Except as set out above TruExperiences Tours will not be liable for any loss, damage or injury of any kind whatsoever to person or property.

CLAIMS
You agree that any claims against TruExperiences Tours shall be made in writing and received by TruExperiences Tours no later than 30 days after the event causing the claim. Claims made after 30 days will not be responded to.

DISPUTE RESOLUTION
The exclusive venue for all claims, actions or proceedings against TruExperiences Tours arising out of this contract shall be the Province of Ontario and such claims, actions or proceedings shall be determined by binding arbitration according to the laws of the Province of Ontario and Canada.

SEVERABILITY
The invalidity of any provision contained herein shall not affect the validity of any other provision. Your deposit indicates acceptance of the above Terms and Conditions and limits on responsibility.
